论民事法律渊源的扩张

通常认为,法律渊源就是法律规范在形式上的表现。本文则试图突破惯常的理解,将法律渊源融入民法学方法论范畴,从法律解释及法律适用的层面,以立体的、动态的视角探究民事法律渊源的实质内涵及运用手段。作者认为,所谓裁判无非是希冀获得一种最利于实现理性和正义的解决方法,而不是只为获得立法者的成文法律规范在其文本实现上的满足。因此,文章将法律原则、习惯、道德律、学理等均作为扩张的民法渊源加以对待,并且就其适用的具体方面进行了阐述。

On Expansion of Sources of Civil Laws
