| Abstract: | After the final judgment of a case of medical accident, the registered doctor Mr. Qian was adjudged bearing no legal liability to the death of a drown boy Yang, but a news agency "adjudged" that the boy's death was due to Doctor Qian. So the doctor soon brought a suit for his reputation right against the judgment of this medical accident case, but he finally lost the lawsuit. Why should he be the losing party in this reputation right case? This paper tries to probe into the legal problem in the second judgment, which concerned the requisites to constitute a harm to reputation right. |
