| 摘 要： | 文章以睡虎地秦墓竹简等简牍为考察中心,结合传世典籍,重新理清秦时的法律制度。以死刑为例,研究发现秦律的死刑以“殊死”作为分类标准,大致可以分为两类：一类是“殊死”的腰斩和枭首;一类是“非殊死”的磔与弃市等死刑。

| Abstract: | The article takes the data of Qin bamboo slips in Shuihudi as investigation object, combines the books handed down from ancient times, and regroups the legal system in Qin Dynasty. With the death penalty as an exam- ple, after researching, we found that the death penalty in Qin Dynasty law took ＂desperate death＂ as a classification criterion,which can be roughly divided into two categories：one is ＂desperate death＂, including cutting the convict from the waist and decapitating, the other is ＂non - desperate death＂, including dismemberment and exposing the body in street after execution. |
