动物法律地位探析

作为一个经济大国、农业大国和畜牧大国,中国亟待加快动物福利立法。在立法推进过程中,动物的法律地位应当如何界定是个首先需要被回答的问题。通过对动物保护的法理基础、国外相关立法以及案例的考量,认为动物不能成为人类道德乃至于法律的主体,而只能是法律关系的客体。但这并不意味着我们反对保护动物。相反,为了人类的可持续发展,对动物的保护必须加强,在这方面,法律是最为重要和有效的手段。我们应当将动物作为特殊的物,在法律上将其与无生命的物加以区别对待,从而实现动物行之有效的保护。

The Consideration for Animals'' Legal Station

To be a giant of great power in economy,agriculture and animal husbandry,it is urgent for china to take action for animal welfare leislation.During the process of it,the legal station of animals have to be definded firstly.After reviewing the theoretical foundation of animal protection and the corelative laws and cases abroad,auther brings forward that animals can not be treat as legal subject,but object.Nevertheless,this dose not mean that we are in the feet of the prevention of animal protection,on the contrary,under the premise of maintaining the existing system and way of life and on the target of keeping and promoting sustainable development of hunman,it must be enhanced,with the cognation that law is the most important and effective channel of it.In order to strengthened the protection of them,animals should be regarded as a kind of special thing,with applicable criterias different from those who has no life.
