On the Securities Market Fund "Rat" Behavior and the Legal Identification

In recent years large numbers of funds ＂Rat＂ phenomenon intensified the discontent and conflict of investors to the parts in the chain and the relevant regulatory authorities,severely blowed the confidence of the market,had a great harm on the capital market. This article analyzes the phenomenon from the ＂Rat＂ behaviors’ technical characteristics,causes,mainly behaviors and legal problems of identification and the practical meaning of relevant legislation for combating ＂Rat,＂ which hopes to promote the renewal of the ideas of combating the crime by judicial organization and the further improvement of legislation.
