政府违宪：危害及防范

由于人民主权的间接性、宪法规范的概括性和权力的易被滥用性,以及现代国家行政权力的扩张等原因的客观存在,政府违宪有其可能性基础。政府违宪常常引起宪法危机,是各种违宪行为中危害最为严重的一种。通过实行法治在事前防范违宪行为的发生,在事后追究违宪行为的法律责任,通过培养宪政思维,或在现行宪法体制的框架内化解违宪行为,可以防范政府违宪。

The Hazardous and Precaution of Government Infringe the Constitution

Because of many objective reasons,such as the indirect character of people's sovereignty,the summary character of the constitution norm,the character of power of being abused easily, and some norms of the constitution are not perfect,the expansibility of administrative authority in modern states,the possibility of government's infringing the constitution is large. The acts of government's infringing the constitution,which often lead to the constitution crisis, are most serious. To avoid or head off the constitution crisis, we should implement the rule of law to take precaution beforehand,find out the legal responsibility afterwards,and last but not least, cultivate constitutional thinking.
