劳动争议“诉调裁”对接机制研究

摘    要:本文从调审分离的视角入手,提出合理整合现有的调解、仲裁和诉讼机制:依据案件是否经过调解作不同的分类处理,在诉讼前对非诉调解协议进行司法确认,诉讼立案时建立立案调解及速裁机制,诉讼中以诉讼和解机制代替诉讼调解,并设置专门的调解组织,使主持调解的组织和人员专门化。

Abstract:From the perspective of the separation of mediation and trial,this article recommends establishing a mechanism for reasonably integrating the current mediation,arbitration and litigation.The mechanism should include the following aspects: different classifications of cases should be made according to whether or not the cases have been handled through mediation,judicial confirmation of non-litigation mediation agreement should be conducted before court proceedings,mediation and instant arbitration mechanisms...
