经济法学基本理论研究的困境与出路

经济法学界在基本理论问题的研究上存在着比较严重的混乱现象.其主要原因在于对中国经济法现象缺乏独立的思考,对中国国情和中国经济法的基本任务认识模糊,理论建构与时代发展严重脱节.中国经济法不是成熟市场经济的产物,而是伴随着我国传统计划经济体制的深刻变革,在建构现代市场经济体制过程中逐步发展起来的部门法律.中国经济法的主要任务或功能不是调整"市场失灵",而是为了推动竞争性市场经济体制的建立;不是为了强化国家干预经济的职能,而是要用法律手段规范和制约政府行为;不是以公共利益否定私人利益或以私人利益否定公共利益,而是要与民法、行政法等部门法一起形成良性互动机制和市场法治秩序,最终切实保障市场主体的正当权益不受非法侵害.

The Predicament of the Basic and Theoretical Study of Legal Economics and Its Possible Solutions

There exists a vexing problem facing the basic and theoretical study of the legal economics. The main reason for this is that there is a dearth of independent thinking about the Chinese economic law, lack of a good understanding of the national conditions and the essential tasks concerning the laws of market economy, thereby a disjointing of theoretical idea. Chinese economic law is not the result of the developed market economy, but rather its objective is to change the framework of the planned economy and base it on modern market economy. Its principal task is not to adjust "market ineffectiveness", but to promote the mechanism of competitive market economy; not to enhance the function of the government intervention of the economy, but to adopt legal measures to regulate and restrict government behavior; not to deny private interests by common interests, but to bring together some department laws, such as civil law, administrative law, to form the fine operative mechanism and legal market order, to safeguard market owner's lawful rights and interests.
