法律职业的社会性分析——兼论我国法律职业现状

法律职业是历史悠久且最具典型性的职业之一 ,法律职业者一般都受统一观念的制约 ,有共同的语言和思维方式并且都必须经过职业培训。法律职业是社会和经济发展的产物 ,西方法律世界的两种教育模式形成了英美国家和欧洲大陆国家两种不同的法律职业形成途径和组织方式。法律职业具有整合法律体系以及维护其权威和自治的功能 ,同时还可以担当“信息中介”的角色 ,并为社会提供法律服务。中国应以司法考试为契机 ,借鉴大陆法系的经验 ,进行法律职业改造 ,形成考试、培训、遴选管理统一化的养成之路。

They must have professional train. Legal profession is the outcome of the development of society and economy. Two kind of teaching systems in the west legal world produce two different kinds of forming ways and organization fashions. Legal profession can conform legal system and its authority and autonomy, can make the action of "information media" and the legal service to the society. China should get the chance of justice test, use the experience of mainland legal system for reference, change the legal profession, consolidate the management of test, train and select.
