| 摘 要： | 遗嘱执行人制度具有保障遗嘱执行,体现遗嘱人意志和公平维护继承人、受遗赠人、其他利害关系人以及便于遗产分配的作用。由于现实国情和法理的需要,我国亟需在遗嘱执行人的产生方式、任职资格、就职和拒绝、权利和义务和法律责任等方面加以完善。

| Abstract: | The system on testament executor plays the role in ensuring testament implement,showing the testator’s will,protecting the heir,the legatee and other interest-related person justly and being good for heritage allocation.Due to the need of present situation and legal principle,it is urgent to improve the producing way of testament executor,position qualification,duty taking and refusal,rights and duty,and the legal obligations in our country. |
