| 摘 要： | 赦免制度能有效弥补法律规定及法律功能之不足，有其存在的必要。但在我国，赦免制度的法律规定呈现一种空白状态，赦免实质上是无法可依。本文着重从立法的角度就如何完善我国赦免制度提出了具体的设想。

| Abstract: | The pardon system is able to make up insufficiency of the legal rule and the legal function,having existence necessity.But in our country,the legal rule of pardon system is taking on a blank condition.In fact,the pardon system has not law to abide by.The article emphasizes on how to perfect our pardon system and come up with concrete plan. |
