推进行政收费设定权法治化简

治理乱收费行为应从规范行政收费设定权入手。实践中，行政收费设定主体众多、层级较低，且设定主体之间权限划分不清等问题依然存在，究其原因，主要是行政主体缺乏对行政收费设定权的统一规定，况且财政供给的不足以及设定主体内部的利益驱动，也促使政府“按需设费”。因此，我国应尽快制定《行政收费法》，对行政收费设定权进行统一规范，按照《立法法》的规定，确定行政收费设定权主体，明确行政收费设定权的权限范围，且在行使行政收费设定权时必需遵循公开原则。

Means to Legal Regulation of Administrative Fees

Regulation of administrative fees, especially abusive charges, should be started from regulation of administration rights. Practically, the major cause of multiple administrative bodies or undefined rights is a lack of uniform regulations for the administrative fees and rights. Besides, insufficient financial support within administrative bodies also drives ＂need based fees＂. Therefore, Administrative Fees Law should soon be passed to set right on administrative charges in accordance with the provisions of Legislation Law.
