| Abstract: | The system of the right of silence has its advantages and disadvantages. It is inappropriate to rashly adopt it. The differences of cultural tradition of different countries should be paid attention to. The current situation of judicial practice in China shouldn't be overlooked. The system of the right of silence is not the only way to check the case of extorting a confession by torture. |
