审判管理新模式初探

探索审判管理新模式具有重大的理论和现实意义。解放思想 ,更新观念是审判管理改革的先决条件。审判管理观念的转变主要反映在五个方面 :管理目标从单一走向双重 ;管理理念从权力本位走向法官本位 ;管理模式从行政走向审判 ;管理权运作从纵向走向模式 ;监督机制从外部走向内部结合。审判管理新模式的内容体现在建立七项机制 ,即 :落实公开审判 ;还权于合议庭 ;实施分权制约 ;全面质量管理 ;审判民主化科学化 ;培养高素质法官 ;完善后勤保障。

On the New Pattern of Trial Administration

It is theoretically and realistically significant to probe the new pattern of trial administration. Emancipation of ideology and renewal of ideas are the precondition of the reform of trial administration. The reform of trial administration concept is reflected in the following five respects: the shift of administration target from unitary to dual; the shift of administration concept from power standard to judge standard; the shift of administration pattern from executive to trial; the shift of exercise of administration power from vertically to horizontally; the shift of supervise mechanism from external to internal. The new pattern of trial administration is mainly to establish seven mechanisms: implementing public trial; returning the rights to discussing court; exercising check and balance; total quality management; democratic and scientific trial; cultivating high quality judges; bettering logistic guarantee.
