我国司法解释的机能转换

我国现行司法解释的机能转换首先在于淡化其历时已久的权力光环 ,还司法解释作为一种司法手段的本来面目。审判权与检察权在司法性质上确有差异 ,基于案件裁判的客观要求 ,我国司法解释应定位在一级多元的层次上 ;应更多地关注法官裁判案件时的“职权解释”以及最高法院公报的案例 ,并将司法解释的内容界定在立足于法律文本的解释 ,合理地运用其拾遗补缺的功能完善现行法律。

Functional transformation of Chinese current judicial interpretation is firstly to pay less attention to its long-standing authority function and restore its true features as a judicial means. The trial authority and procuratorial authority is indeed different. In the light of the objective demand of case trial, Chinese judicial interpretation should be positioned as the rank of one class with multi-levels, and should be more concerned about the functional interpretation by the judges while hearing the cases and about the cases published by the Supreme Court. The content of judicial interpretation should be based on the interpretation of legal texts should reasonably employ the function of making good omissions and deficiencies in order to improve current law.
