论控辩平等的价值取向及现实意义

控辩平等问题是刑事审判改革中的核心内容。我国现行实判制度在控辩平等方面还存在诸多不足。控辩双方是对立统一的关系。法官只能作为案件事实的认定人和适用法律的裁决者。实现控辩平等有利于形成合理的诉讼结构 ;有利于实现刑事诉讼中的实体正义 ;有利于提高检察机关的公诉水平 ;有利于健全我国的刑事辩护制度。

On the Value-orientation and Significance of the Equality of the Prosecution and the Defense

The equality of the prosecution and the defense is the core of the reform of criminal trial. There exist some problems in the respect of Chinese trial system. The prosecution and the defense has the relation of unity of opposites. The judge serves as the fact-finder and decider of applying the law. Realization of the equality of the prosecution and the defense is beneficial to constituting the sound adjudication structure, realizing the substantive justice in the criminal prosecution, to heightening the level of procuratorial prosecution, to perfecting the system of criminal defense in China.
