未成年矫正对象的特点及社区矫正制度的基本要求

未成年矫正对象在个性特征、认识特征、情感特征、意志特征等心理特征、行为特征方面都不同于成年矫正对象,因此对这一特殊群体进行社区矫正在矫正定位、矫正责任、矫正知识、矫正措施等诸多方面均具有相关的应然性特点,如矫正定位应具有更加谦抑的惩罚性征,矫正人员应具有更加强烈的人伦责任,矫正人员应具有更加丰富的专业知识,矫正措施应具有更加亲和的体系安排等。故而,未成年人社区矫正作为一种制度设计应被赋予其独立的话语权。

Juvenile delinquents are different from adult criminals on the traits of behaviors and psychology,such as individuality,cognition,emotion and will, etc.Therefore the community-correction system,which is carried out aiming at the juvenile delinquents,accordingly is of characteristics in the aspects of location,responsibility,knowledge and measures.That is,the punishment trait of correctional location should be milder;the correctional personnel's humanity responsibility should be stronger;the correctional personnel should acquire more professional knowledge;the correctional measures should include more intimate systematic arrangement;and so on.Therefore,juvenile-community-correction should be independent as a system.
