侦查机关如何应对新刑诉法侦查程序的修改

On the Investigation Departments' Adaptation to the Modification of the Investigation Procedures in the New Criminal Procedure Law

The old Criminal Procedure Law endows investigation departments with much power while the counterparty＇s rights are endangered. Modifications by the new Criminal Procedure Law of the investigation procedure include mainly the following aspects： First, the new version expands the lawyer＇s right to participate in the investigation procedure, giving lawyers the defender＇s position; Second, it reforms part of the mandatory measures; Third, it legalizes technical investigation; and Fourth, it establishes illegal evidence exclusion and allows policemen to act as witness. Accordingly, the challenges and coping strategies facing the investigation departments are as follows： First, the work view must change; Second, the traditional investigation mode should shift to modern investigation mode; Third, the current relationship between investigative and prosecutorial authorities must change from mutual independence to cooperation.
