| 摘 要： | ＂强制罪犯劳动＂,是世界大多数国家现时的通行作法。＂强制罪犯劳动＂的＂本质＂应该是指监狱强制罪犯劳动的目的与职能。目的与职能不同,监狱组织罪犯劳动在＂形式、内容、种类与要求＂上也表现不同。从历史演化过程看,我国监狱强制罪犯劳动的主要职能应该界定为：废止惩罚功能、限定经济功能、抑制行刑功能、拓展矫正功能。

| Abstract: | Criminal＇s compulsory labor is very common in many countries at present.The characteristics of criminal＇s compulsoy labor should be the ambition and function of criminal＇s compulsory labor in the prison.The ambition and function are different,so the ways,contents,styles and requirements are different in the prison＇s organizing crime to work.From the process of history evolution,the main function of criminal,s compulsory labor in China should be defined as： abolishing the function of punishment,limiting the function of economy,restraining the function of sentencing,broadening the function of correction. |
