| 摘 要： | 一起警察不作为行政赔偿诉讼案引起如下思考:行政不作为是否承担赔偿责任?如何确定因果关系?承担何种赔偿责任?最高院通过司法解释确定了警察行政不作为应当承担赔偿责任,而确定因果关系可以采用相当因果关系说;承担的责任形式应当是连带责任而非按份责任。

| Abstract: | The following thought are led to by administration compensation suits case of the police negative act:Administration negative act is whether to assume the liability to pay compensation?How to setablish cansal relationship? Which compensation duties are assumed? Superme People's Court defines that administration negative act should assume the compensation duty by judicial intepretation of law.Establishing cansal relationship can adopt suitable causal relationship.Assuming duty form should be joiut liability,not duty by shares. |
