| 摘 要： | "产权式商铺"是近些年产生的一种新事物,对推动我国经济的发展发挥了积极的作用,但是,在分散产权后追求统一经营的过程中,却忽略了产权分割与统一经营之间的法律障碍.通过对"产权式商铺"在"统一经营"模式下的委托经营、售后包租、按份共有、业主公决等问题在法律层面的简要分析,以期对相应的立法提供参考和借鉴.

| Abstract: | "The property right type store" is one kind of new things which is born in the recent years.It impelled our country's economy development,but,during the process it pursued the uniform management after the disperser property right,actually,it has also neglected the legal barrier between the property right division and the uniform management.This article drafts "the property right type store" under the pattern of "the unitive management",makes brief analysis about submitted management,the post-sale fixed rent for house,co-ownership by shares,and so on from the legal stratification,tries to provide a reference for the corresponding legislation. |
