| 摘 要： | 立足于中国国情 ,着眼于科学借鉴国外的有益经验 ,坚持理论和实际相结合 ,我国应适时建立沉默权制度 ,即有限沉默权制度。并追求在既不降低对犯罪的有效打击 ,又有利于充分保障公民的合法权益 ,尤其是司法诉讼中的权利的情况下 ,努力实现司法公正和司法文明 ,保护社会和保障人权的有机统一。

| Abstract: | Considering on the current situation in China, this author suggests that a so-called "limited system of right of silence" be established before the complete system's application in this country. In doing so, the citizen's legal rights could be effectively protected while cracking down on crimes, and the realization of judicial civilization and justice could be guaranteed. |
