| 摘 要： | 我国金融融资较高的准入条件,迫使众多中小企业难以获得正规融资渠道,从而走向民间融资道路。但不健全的法律制度促使金融融资案件频发,尤其动辄入罪的高风险使民间企业生存空间越发窄小。针对我国刑法条文第176条非法吸收公众存款罪的威慑,有必要在理论路径中对诸多疑难点解释清晰,真正区分出民间合法借贷与非法吸收公众存款罪的界限。

| Abstract: | access to Financing Higher Finance in China, forcing many small and medium enterprises difficult to obtain formal financing channels, to the folk financing road. But the legal system is not perfect to finance the frequent cases, especially at high risk of crime. The folk enterprise living space more and more narrow. According to our country criminal law article 176 th of the crime of illegal absorbing public deposits deterrence, it is necessary in the theory of the suspicious difficult path clear, the real limits to distinguish civil legal lending and the crime of illegal absorbing public deposits. |
