| 摘 要： | 作为法学特有方法的规范分析方法并未得到"认真对待",学界对该方法的本体存在着"融合论"、"规范论"和"逻辑思维论"的学说分歧。为有利于该方法在法学研究中的运用,确立如下要义对该方法而言是必要的:规范分析方法的作用对象是一国现行有效的法规范整体(即实在法体系),其秉持"价值中立"的价值立场,是逻辑分析、语言分析等方法所构成的方法体系。

| Abstract: | There is divergence about the essence of norm analysis method, which is composed of the following three viewpoints：fuse-proposition, norm-proposition and logic-proposition. However, in my opinion the central essentials of norm analysis method should be：（1）taking positive law as object;（2）taking a netrual-value stand;（3）the method system being consist of logic analysis, linguistic analysis,etc. |
