老挝民诉法最新修正案介评

2012年7月4日老挝通过了新的民事诉讼法修正案即新法。新法扩大了法院非诉讼案件的受案范围;将调解上升为民诉法的原则;强化了检察机关民事检察权行使的操作性;增强了诉讼参与人的权利保障;加强了证据立法;增加了执行程序和非诉程序;加大了强制措施力度;完善了再审程序和涉外诉讼程序。但是,新法也存在证据规则体系不够完整,执行制度设计上过于简约,程序制衡性机制操作性有待提高等诸多局限性。

Reviews on the Latest Amendment to the Civil Procedure Law of Laos

On July 4th, 2012, the latest amendment to the Civil ProCedure Law, i.e. the New Law was laos. It expands the scope of court acceptance of non litigation cases; upgrades mediation to principles; strengthens the operation of civil procuratorial power of the procuratorial organs; passed in civilprocedure law enhances right and interest guarantee of the participants in the proceedings; improves the legislation of evidence; adds executive procedure and non litigation procedure; enlarges the level of compulsory measures and perfects the retrial procedure and litigation procedure over foreign cases. However, the New Law also has limitations including rules of evidence system being incomplete; designs of the implementation system being simple and operations of the procedure restriction mechanism needing to be improved.
