论公共危机中的行政补偿

目前,我国关于公共危机领域内的行政补偿法律制度几乎是一片空白,该领域的行政补偿政策调整的倾向十分明 显,随意性和不公正性问题严重,这已经严重影响到政府在危机管理中紧急权力的有效运作和对人权的基本保护,也显然与我国 实施的依法治国方略背道而弛,亦有背于当代宪政精神,更不符合当前依法行政的实际需要。因此,有必要建立和完善我国,厶＼共危 机中的行政补偿法律制度,确定实施行政补偿的原则,明确行政补偿的范围,规范行政补偿的程序及救济。
