| 摘 要： | 汉宣帝时，路舒温在《尚德缓刑书》中向皇帝揭示法制现状和分析其成因，建议一改秦朝“贱仁义之士，贵治狱之吏”的弊端，应该尊文武之德，省法制，宽刑罚，充分表明了其儒家思想的主张。路舒温归属于贤良文人派，他们的言论表明了汉武帝之后儒法之争的继续，说明儒家思想在汉朝政治上的确立并非一蹴而就，而是一个缓慢“霸王道杂之”的合流势态。

| Abstract: | In the reign of Emperor Xuandi of the Han dynasty, LU Shu-wen in his book Shang De Huan Xing Book revealed to the emperor the legal system of that time and analyzed its reasons. He suggested to drop the mistake of Qin dynasty that ＂underestimated the civil servants and valued the prison guards＂. Instead, LU Shu-wen thought it necessary to respect for the civil and relieve the law, which indicated his favor of Confucianism. Being a member of virtuous literati, LU and his allies＇ propositions showed the continuance of the debate between Confucianism and legalism after Emperor Wudi of the Han dynasty. The situation indicated that the dominant position of Confucianism in the Han dynasty was not built in a day but followed the tendency of ＂combining hegemonism and kingcraft＂. |
