| 摘 要： | 突发事件中犯罪组织活动日渐隐蔽化，给取证工作带来很大困难，卧底侦查越来越彰显出其独特的价值。本文结合国外立法经验，论述了突发事件取证中卧底侦查的实质合法性与形式合法性，并结合我国法律规定从适用条件、行为方式、适用程序、证据使用四个方面阐述了对突发事件取证中卧底侦查的限制。

| Abstract: | The activities of criminal organizations in emergency are increasingly covert, bringing great difficulties to the work of obtaining evidence. Therefore, undercover investigation shows its unique value gradually. Drawing on the experiences of foreign legislation, this article discusses the intrinsic legitimacy and the formal legitimacy of undercover investigation in the process of obtaining evidence on emergency. According to the law of China, the paper, from the following four aspects, elaborates on how to limit undercover investigation when obtaining evidence on emergency, namely, applicable conditions, behavior, applicable procedures and the use of evidence. |
