检察机关外部关系监督性之中外溯源

对于检察权究竟是司法权还是行政权、检察机关到底应归于行政机关抑或司法机关，各国理论评价和现实状况都是不尽相同的，但检察机关在对外关系上所具有的监督属性是逐渐增强的。这种监督属性的产生，一方面在检察机关产生之初已经具备，具有其历史必然性。另一方面也是法治文明发展的推动。因此，在近、现代，各国纷纷确立了对外关系的监督属性。
