| 摘 要： | 片面共犯在现实中的客观存在是不容置疑的事实,其具有犯罪性与可罚性。片面共犯不是特殊的共同犯罪,也不同于单独犯,更不能等同于间接正犯,片面共犯应视为一种特殊的独立的犯罪形态。
