民初法律冲突中的孀妇改嫁——以大理院解释例为素材的考察

孀妇改嫁为传统社会的惯常现象。民国以后，此“旧现象”与“新潮流”难免造成法律冲突。在西风东渐的年代，对于孀妇改嫁的处理，大理院总体上倾向于传统的自愿立场，只是在一定程度上受西方法的影响，给予妇女更多的权利、自由和财产。

The Widow Remarry of Legal Conflicts in Early Republic of China

It was a normal phenomenon that the widow remarried in traditional society.After Republic of China,this "old phenomenon" had unavoidable legal conflicts with the "new trend".In the period of bringing the western ideas into China,the Supreme Court generally inclined to have traditional attitude according to the party's willing,which,to some de-gree,was influenced by the western law to give women more rights,liberty and property,when it handled with the widow's remarriage.
