论民事特别法与民法基本原则冲突时的法律适用--"第三者"受遗赠案法律评析

法官裁判案件,适用法律应遵循法律适用的原则。特别法优于普通法,低位阶规定优于高位阶规定,确定性规定优于不确定性规定,便是法律适用的原则。排除法律的明确规定而适用抽象、模糊的基本原则有可能导致有法不依。《继承法》与《民法通则》基本原则的冲突应通过修改《继承法》以求得妥善而根本的解决。

The Legal Application on the Conflict Between the Basic Principle of Civil Law And the Special Civil Law

When a judge rules a case,he should ob ey the rules on how to apply law,Which implies that the special law is superior to the genera l law,the low level provisions to the high level one,and specific pro-visions to unspecific ones.If a judge does not rule a case according to specific,clear provisions,but to abstract,obscure principles,he ma y abuse his power.The conflict betwe en the basic principle of the General Principle of Civil Law and th e Inheritance Law should be settled b y the amendment of the Inheri-tance Law.
