论我国公务员范围的拓展

我国<公务员法>的颁布具有重大的现实意义和时代导向性.其中,交流与回避制度的精细化、申诉制度的进一步完善、聘任制的确立以及下级对上级说"不"的制度安排,都成为人们赞许和圈点的理由.不过,<公务员法>调整范围的拓展,即公务员的泛化与非专业化,却有违分类管理的发展趋势和时代要求,也必将引发理论上的无谓纷争和现实中的执法混乱.因此,针对该问题展开比较法、行政法、宪法以及立法目的意义上的学术反思,不但有利于公务员制度自身的完善与良性发展,而且必将会对我国时下的宪政改革和法治建设提供智识支持.
