| 摘 要： | 民间法研究的理论基础是民间法研究得以展开并深入发展之根基,因此有必要对民间法研究的理论基础进行一番考量。文章将民间法研究的理论基础置于多元框架下考量,分别从政治国家与市民社会、大传统与小传统、形式正义与实质正义、法律教义学有效性与社会学有效性等方面展开相应的探讨。文章认为,在寻求政治国家与市民社会的良性架构、大传统与小传统的理性沟通、形式正义与实质正义的动态平衡、法律教义学有效性与社会学有效性的适度兼容中,彰显了民间法研究的理论价值及其实践意义。

| Abstract: | The theoretical basis for folk law research is the foundation for carrying out and deepening the research of folk law,so it＇s necessary to study it.The paper puts the theoretical basis for folk law research under the multivariate framework,and launches corresponding exploration from such aspects as political state and civil society,great tradition and little tradition,formal and essential justice,effectiveness of legal doctrines and sociology.The article believes that seeking the good framework of political state and civil society,rational communication between great and little traditions,dynamic balance between formal and essential justice,and combination of the effectiveness of legal doctrines and sociology have embodied the theoretical value and practical significance of studying folk laws. |
