| 摘 要： | 犯罪侦查属于国家刑事司法行为。尽管犯罪侦查是具有极强对抗性和博弈性的活动,但在犯罪侦查中也需要讲诚信,因为缺失诚信的国家刑事司法行为势必影响国家形象,而且也会动摇人民群众对法律的信心,并将对刑事司法效益尤其是刑事司法的长远效益造成损害。当然,在犯罪侦查中并不绝对地排斥在一些特殊条件下使用带欺骗因素的手段,在合理范围内使用这类侦查手段具有一定的法律许容性。

| Abstract: | Criminal investigation is a kind of state criminal judicial conduction.Although it's full of extremely strong antagonism,we should seek integrity in the course of it,for judicial acts lacking of integrity will result in bad influence on state image.Moreover,it will also shake people's confidence in law and eventually damage the effectiveness especially the long-term effectiveness of criminal justice.However,using of some deceptive means under certain circumstance is not absolutely excluded in criminal investigation.Making use of these sorts of means of investigation within reasonable limits is permitted. |
