| 摘 要： | 行政程序当中的调解在解决商标损害赔偿纠纷时具有行政执法制裁和司法救济所无法比拟的优势。但商标损害赔偿毕竟是私法上的请求,因而行政调解的适用应受到一定的规制,并且需要在实践当中不断更新与完善。
