论麦耶（Mayer）的构成要件理论

在大陆法系犯罪论体系的发展历史中,麦耶的构成要件理论地位十分特殊。一方面他继承了贝林(Beling)开创的构成要件理论,认为构成要件与违法性是相互分离的两个评价层面;另一方面他又超越了贝林的理论,认为在构成要件中存在规范的构成要件和主观的违法要素,因此构成要件是违法性的认识根据。由此可见,麦耶的理论是古典犯罪论体系与新古典犯罪论体系之间的过渡,他既完善了贝林的构成要件理论,又为梅兹格(Mezger)的构成要件理论奠定了基础。

Transition from the Classical Crime Theory System to the Neo-Classical Crime Theory System

Mayer's theory about the element of crime is very exceptional in the history of the theory of crime in the continental law system.On one hand,he inherited Beling's theory about the element of crime.He argued the element of crime and the violation are two different appraisal systems.On the other hand,Mayer's theory about the element of crime transcends Beling's.He considered that there are the normal element of crime and the subjective element of violation in the element of crime,which is the cognitional basis for violation.So Mayer's theory is the transition from the classical crime theory system to the Neo-Classical crime theory system.His theory not only polished the theory about the element of crime held by Beling,but also laid the foundation for Mezger's theory about the element of crime.
