人文关怀视野下我国缓刑制度完善之思考

由严酷走向缓和 ,由野蛮走向文明 ,是刑罚发展的历史规律。随着人文精神的深入 ,矫正理论的崛起 ,刑罚个别化、社会化的影响越来越广泛。体现人文关怀的缓刑、减刑、假释、社区服务等刑种、行刑方式的地位和作用越来越突出。本文在肯定我国现行缓刑制度体现人文关怀价值积极性的同时 ,针对我国缓刑制度在司法实践中存在的弊端 ,从人文关怀角度 ,对刑法的缓刑制度予以评析 ,对完善缓刑制度进行探讨 ,以期推动立法者更深入地对缓刑制度进行完善。

Consideration of the Perfection of Probation System in China

From cruelty to gentleness,from wildness to civilization,it is the historical rule of the development of penalties. The penalties,such as probation,commutation,parole,serving community,which embody humanity,have become more and more important and noticeable. The article affirms the positive factors of probation systems as much as humanity concerned and at the same time puts out that there are still some abuses in judicatory practices. The author also discusses how to perfect probation systems.
