| 摘 要： | 证据是诉讼的灵魂和核心,而证人证言又是证据种类中不可或缺的组成部分。然而,在司法实践中证人出庭率低、说真话率低,被法院采用的就更低。这严重妨碍法院查明案件事实真相,制约了办案效率,影响了当事人正当权益的实现。我国证据制度中有关证人出庭作证制度的不完善是其主要原因,因此,必须完善我国证人作证制度。

| Abstract: | The evidences are the core of the litigation,and the witness's testimony is necessary part in all kinds of proofs.But in the practice,the rate of the witness appearing in the court is very low,the truth is not so much and the words being used by court is much less.All these baffled the court to find the truth,reduced the efficiency and affect the realization of the interests of the party.The system of the witness appearing in the court is not perfect is main reason for it,and we should perfect the system. |
