摘    要:实施研发补贴是国家发展民用飞机产业的必由之路。研发补贴是SCM协定下的可诉性补贴。SCM协定对研发补贴可诉的条件进行了界定,但由于规则的模糊性,现行SCM协定相关规定亟待完善和发展。WTO争端解决实践对于研发补贴的可诉条件进行了新的澄清和发展,这对于中国设计和实施科学的民用飞机研发补贴提供了新的启示和对策。

Abstract:Providing research and development subsidies is the only way for a state to promote the development of national civil aircraft industry.research and development subsidies is one of the actionable subsidies in SCM agreement.SCM agreement defined the conditions for actionable R&D subsidies,but the regulations are ambiguous.It is essencial to perfect the existing SCM agreement.The practices of WTO Dispute Settlement Body developed and clarified the actionable conditions for R&D subsisies.It provided some inspirations for Chinese government to design and implement R&D subsidies measures.
