| 摘 要： | 《海峡两岸经济合作框架协议》的签署对海峡两岸的经贸合作产生了重大而深远的意义。在全面回顾ECFA的基本内容、深入分析其法律性质的基础上，具体分析了ECFA对海峡两岸经济合作法制的影响，以及ECFA签署后亟待解决的部分法律问题，从司法审判的视角，提出了完善立法规范、探索建立多种争端解决机制、加强两岸权力机关、司法机关的交流合作、保障法律实施等方面的建议。

| Abstract: | The signing of The Cross-Strait Economic Cooperation Framework Agreement has produced significant and profound significance on the economic and trade cooperation between the two sides of the strait.Based on the comprehensive review of ECFA’s basic content and the thorough analysis of its legal character,this paper specifically analyzes ECFA’s influence on the cross-strait’s economic cooperation legal system,and from the perspective of judicial judgment puts forward the suggestions about improving legislation,exploring a variety of dispute settlement mechanism,strengthening the communication and cooperation between the power organs and judicial organs of both sides,ensuring legal implementation. |
