不确定的法律概念与司法审查

不确定的法律概念是指未明确表示而具有流动的特征之法律概念,其包括一个确定的概念核心以及一个多多少少广泛不清的概念外围。不确定的法律概念的存在是由法律语言的模糊性决定的。对不确定的法律概念的解释、适用,理论上就有可能存在多数适当的判断决定。那么行政机关就不确定的法律概念的适用,是否存在不受法院审查的决定权限?这确实是公法学上的一大难题,也是公法学的一大重点问题,具有非常重要的现实意义。对不确定法律概念的涵义、适用以及判断余地理论分析研究,对我国行政诉讼具有现实意义。

Indefinite Law Concept and Judicial Review

Indefinite law concept means that the concept can not be interpreted definitely,but has its varying characteristic.It consists of a definite core concept and a more or less indefinite concept extension.The existence of indefinite law concept is determined by the indefinite nature of legal language.The interpretation and application of indefinite law concept may make a decision to judge the majority suitability in theory.Whether having a deciding competence without judicial review when the administrative organ apply indefinite law concept or not,is a most difficult and important problem in public law study,and also has its realistic significance.This article further points out the realistic significance of this problem to the administrative proceedings of our country through studying and analyzing the connotation,application and the theory of judgment space of indefinite law concept.
