浅议农民的社会保障权

社会保障权是公民的一项基本权利,属于社会经济权利的范畴。在我国城乡二元结构体制下,社会保障制度也是二元的,农民的社会保障权成为一个特殊的社会问题。农民社会保障权的法律价值主要体现为:社会公平、自由和生存。我国应当改革户籍制度,打破城乡壁垒,消除身份差异,消除障碍,建立健全社会保障制度,促进农民社会保障权的实现。

Social security right is one of citizen's basic rights which belongs to the category of social economical rights.Under our country's system of city-countryside duality structure,due to the duality social security system,farmers' social security right has become a special social problem.The main legal value of farmers' social security right is embodied as social fairness,freedom and existence.China should reform the household registration system,break the barriers between city and countryside,eliminate differences of identity and obstacles,establish and perfect social security system to make farmers' social security right come true.
