| 摘 要： | 中国在清末的法律转型时选择了大陆法系并以此建立了自己的法律体系。上世纪 90年代中国在立法和司法等领域出现了一系列的判例法倾向 ,这种倾向是中国法制走向完善和成熟的标志。中国的判例法倾向将为中国未来的法制走向提供更丰富的想象和创造空间 ,也将为中国形成独具特色的法律体系产生影响

| Abstract: | China chose the civil law and established her own legal system during the law-transforming period at the end of Qing Dynasty. A series of tendency to case law emerged in some fields of the Chinese legislation and judicature in 1990's, which is the symbol of the Chinese law construction developing to be improved and perfect. Such tendency will provide much more imagination and creating room for the future of Chinese law, furthermore, put great influence on shaping Chinese-character legal system. |
