略论农民权利的性质和表征——兼及实现农民权利的路径选择

农民问题的核心是权利问题。农民作为一个群体，既有与其他群体相同的权利，又有着自己群体固有的权利。农民权利具有基本性、身份性、不平等性、贫困性、个体性及法定性等特征。改革开放30年来，中国农民权利有了很大的发展，但是由于各种主、客观因素的影响，农民权利仍凸显不足。该文提出，要构建立法、执法、司法及提高农民法律意识四位一体的保障机制，才能最大限度地实现农民权利。

Characteristics and Realization of Farmers' Rights

Farmers＇ rights are of the core of issues related to farmers, which, as a social group, have the equal rights enjoyed by other social groups, while possess their inherent rights as well. Farmers＇ rights are characterized by fundamentality, identity, inequality, fragility, individuality and legality. After 30 years of reform and opening up, the realization of farmers＇ rights in China has made huge achievements while remains insufficient in many areas. It is essential to build security mechanism in terms of legislation, law enforcement, judiciary and farmers＇legal awareness in a bid to realize farmers＇ rights to the maximum extent.
