拐卖犯罪中连续犯跨越不同法律时段触犯不同罪名的定性研究

由于法律的修改 ,同一犯罪行为在不同的法律时段有不同的罪名和不同的量刑标准。而同一行为在不同法律时段中触犯的不同罪名 ,其犯罪构成有一定的共性 ,也有不同程度的差别。连续犯本应定一罪 ,却因跨越不同的法律时段而触犯了不同的罪名 ,其定性也就成为相当棘手的问题。司法实践中此问题在拐卖犯罪案中尤为突出 ,本文对此略作探讨 ,提出了问题的解决方案 ,并兼论其他。

Nature Determination of Kidnapping Happened Continuously in Different Time and Violating Different Charges and other Issues

Since the law has been revised, the same crime in different time should be charged differently and there are different standards for measurement of penalty. But the same action, which violates different charges in different time, has some similarities as well as differences in crime constitution. Continuing offense should be charged once. But it also violates different charges for leaping over different time, so it is a knotting problem in nature determination. In the practice,this problem is more troublesome in kidnapping case. This essay probes into it, suggests some solutions and discusses other issues.
