| 摘 要： | 制定法具有体系完整、逻辑严密、结构科学等优点,但也呈现一定的局限,其表现为一般规则对个别案件之局限;有限规则对无限客体之局限;模糊规则对确定事项之局限;确定规则对发展事物之局限;刻板规定对丰富内涵之局限等.制定法缺陷的主要弥补方式有:确立法律原则、制定法律解释、认可社会习惯、确定类推制度、设立一般条款、创立判例制度等.

The Effective Remediation Way of Limitation of the Positive Law |

| Abstract: | The positive law has strongpoints such as system integrity,logic strict,structure science,and also presents certain limitation,eg general rule to individual case;limited rule to infinite object;fuzzy rule to the things determinate;determinate rule to developing item;starch stipulation to rich connotation and so on.The main reparative way for the positive law includes: to establish legal principle and the formulation of law,approve social custom,confirm the analogy system,sets up general provisions,and establish legal precedent system. |
