立宪主义在亚洲

本文始以探究立宪主义的内在规定性 ,包括其规范要求及价值内核 ,并以现代性为背景 ,追问立宪主义的普适性。以此为前提 ,主要从分权与制衡及人权保障两个方面描述立宪主义在亚洲的际遇 ,并侧重从政治学、社会学的视角给以解析。结语进一步廓清立宪主义得以在亚洲确立的条件 ,并对在亚洲确立立宪主义的前景有所冀望。但未提出“亚洲立宪主义”的明确概念。

Is the Constitutionalism in Asia

This thesis begins with the exploration of the inwardness of the Constitutionalism, including its requirement on system and its worthiness, and then pumps its popularity on the background of the Modernity. Depending on all the premises, the writer depicts the favorable situation of the Constitutionalism in Asia on the sides of the decentralization of three powers in country and checks and balance of these three powers and guarantee of human rights, and then analyzes these circles particularly in the politics and sociology. In the conclusive part of this thesis, the writer deals with the conditions to establish the Constitutionalism in Asia more and while giving good hopes to the foreground of the Constitutionalism in Asia. Nevertheless, the writer doesn't offer a specific concept of the Hamito-semitic Constitution.
