在执法实践中,屡有基层民警违法、滥用徒手强制导致相对人伤亡,不敢使用徒手强制损害公安机关执法权威、危及自身安全的情况出现。因此,探讨使用徒手强制的适用条件与情形,明确相关使用要求,具有重要的现实意义。以相关法律规定为依据,结合公安执法实际情况,笔者从使用徒手制止现场违法犯罪行为、执行各种强制措施以及现场抓捕与强行带离三方面出发,系统探讨使用徒手强制的条件、情形,并明确相关使用要求,以期引导公安执法的规范化。

Applicable Conditions and Circumstances of Using Unarmed Compulsion by Police

In the practice of law enforcement,the grassroots police often lead to casualties of the other party as a result of illegally using or abusing unarmed compulsion while doing harm to the law enforcement authority of public security organs and endangering their safety due to not daring to use unarmed compulsion.Therefore,it is of great practical significance to discuss the applicable conditions and circumstances of using unarmed compulsion in order to make it clear.According to relevant laws and regulations,this article systematically probes into the applicable conditions and circumstances of using unarmed compulsion and make clear relevant using requirements in the expectation of guiding the standardization of public security law enforcement from three aspects of restraining illegal criminal acts,carrying out all kinds of compulsory measures,arresting at the scene and taking away by compulsion in combination with actual circumstances of public security law enforcement.
