| 摘 要： | 行政立法兼具行政和立法的双重性质,它以效率和民主为基本价值取向。民主和效率在行政立法中是统一的,它们既相互保障又相互促进。审视我国行政立法的理论和实践,应当确定民主价值取向的优先地位,以效益促效率,形成注重效益的效率观。建立并完善成本——效益分析制度应成为其调整和改革的重点方向。

| Abstract: | Administration legislation is both administrative and legislative. Its basic value orientations are democracy and efficiency. As far as administration legislation is concerned, democracy and efficiency are unified, protecting and improving each other. Based on the theory and practice of Chinese administration legislation, the superior position of democracy value must be established. It is also necessary to make benefit motivate efficiency, establish and perfect the cost-benefit system. |
